1. Acceptance. By accessing or using the Jar Test Calculator (the "Tool"), you agree to these Terms of Use & Disclaimer (the "Terms"). If you do not agree, do not use the Tool. "We," "us" and "our" mean the developer(s) and operator(s) of the Tool and any sponsor named on it, together with each of their parents, subsidiaries, affiliates, officers, directors, employees, agents, contractors, successors and assigns.
2. Reference tool only. The Tool is a math aid that scales rates you enter down to a test jar or up to a tank load. It provides general reference information only. It is not agronomic, legal, regulatory, safety or professional advice, and it is not a recommendation to use, mix or apply any product, rate or combination. Any example products, rates or mixtures shown are for illustration only and are not recommendations, and they may not be permitted by a product's label for your crop, site, timing or use.
3. The label is the law. Always read and follow each product's label, including rates, maximums, tank-mix restrictions, mixing order, application timing, personal protective equipment (PPE), re-entry and pre-harvest intervals, buffer zones, and storage and disposal directions. If anything in the Tool conflicts with a label, the label controls. Do not tank-mix products whose labels prohibit it. You are solely responsible for complying with all applicable federal, state and local laws and regulations, including applicator licensing and record-keeping requirements.
4. Limits of a jar test. A jar test checks physical compatibility only, under the conditions of that test. A passing jar test does not show that a mixture is chemically or biologically compatible, safe for the crop, effective against the target pest, or free of antagonism. Results in a spray tank can differ because of water quality, temperature, agitation, mixing order, carrier, equipment and time. Consult the product manufacturer, a qualified agronomist or crop advisor, or your local extension office before relying on any mixture.
5. Your responsibility. You are solely responsible for the values you enter, for checking every calculated amount before use, for measuring accurately, and for all decisions about mixing, loading and applying any product. Calculations depend on your inputs and on rounding, and may contain errors. Handle all products with the PPE and precautions the label requires. Keep test jars labeled and away from food, drinking containers, children and animals, and dispose of test mixtures according to the label.
6. No warranties. THE TOOL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, AND ANY WARRANTIES THAT THE TOOL WILL BE UNINTERRUPTED OR ERROR-FREE. YOU USE THE TOOL AT YOUR OWN RISK.
7. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS, ARISING OUT OF OR RELATED TO THE TOOL OR YOUR USE OF IT, INCLUDING CROP INJURY OR LOSS, REDUCED YIELD, LOSS OF PRODUCT, EQUIPMENT DAMAGE, TANK OR SPRAYER CLEAN-OUT, DRIFT, OFF-TARGET MOVEMENT, ENVIRONMENTAL OR PROPERTY DAMAGE, PERSONAL INJURY, REGULATORY PENALTIES, OR LOST PROFITS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF ANY LIABILITY IS FOUND DESPITE THESE TERMS, OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
8. Indemnification. You agree to defend, indemnify and hold us harmless from any claims, demands, losses, damages, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Tool, any mixture or application you make, your violation of these Terms, or your violation of any label, law or third-party right.
9. Trademarks and third-party products. Product and company names in the Tool may be trademarks of their respective owners. Their appearance, including in examples or as a sponsor, does not mean any owner has reviewed, verified or endorsed any calculation, rate or mixture produced by the Tool.
10. Your data. The Tool does not ask for personal information. What you type is saved only in your own browser on your device so it is there next time. It is not sent to us. Our hosting provider may keep standard technical logs, such as IP addresses, as part of serving the page.
11. Changes and availability. We may change, suspend or discontinue the Tool or these Terms at any time without notice. Continued use after a change means you accept the updated Terms.
12. General. These Terms are governed by the laws of the State of Kansas, USA, without regard to conflict-of-law rules, and any dispute will be brought only in the state or federal courts located in Kansas. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest will remain in effect. Our failure to enforce any part is not a waiver. These Terms are the entire agreement between you and us about the Tool.
This removes every product and rate. Your GPA and jar size stay the same.
For jar testing and reference only. Always read and follow product labels.
